Terms of use for studios

1. The service

Garmushka is an online workspace for interior design studios and architects: bills of quantities that suppliers price online, quote comparison, project stages and a board, hired suppliers, payments, tasks, snags, documents and photos, a customer area for the studio’s customers and a supplier area for its suppliers. The service is operated by Garmushka.

2. Accounts

Signing in is by a link or code sent to your email, or with Google. You are responsible for keeping access to your mailbox and Google account secure, and for everything done in your account. Whoever invites people to the studio, its projects, its customer area or as suppliers is responsible for the roles and the access they give them.

3. Plans and trial

• Quoting (bills of quantities, sending them to suppliers and comparing quotes) is free forever, on the free plan.
• A new studio gets a 30-day full trial of every feature. After it, without a paid plan, project tracking features turn read-only: nothing is deleted, and quoting keeps working.
• The paid plans, their prices (before VAT) and the number of people each includes are as shown on the pricing page. A yearly payment covers 12 months for the price of 10.
• Launch offer, while places last: the first 50 studios that start paying get 20% off a paid plan for the first 12 months from opening the account, the trial included. Paid annually, the year costs 20% less than 12 months’ price, instead of the annual discount, not on top of it. A place is taken when the studio moves to a paid plan, while one is left; test studios do not count. The discount is recorded with the studio.
• Promo codes: a studio can use one promo code, from a link or typed in its settings while on its trial or on the free plan. A code does not combine with any other discount, neither the launch offer nor paying annually: the studio keeps whichever is worth more. A discount is recorded with the studio and applies once billing starts; extra trial days are added at once. Each code has the conditions shown with it and may be limited in number or in time.

4. Your information

The information a studio enters — customers, projects, suppliers, bills of quantities, quotes, payments, documents and photos — belongs to the studio. You allow us to use it only to provide the service, to back it up and to keep it secure. You can ask for a copy of it at any time. We process the personal information in it on your behalf under the data processing agreement for studios, which forms part of these terms.

You are responsible for having the right to enter the information and to share it with suppliers and customers, including giving your customers and suppliers the information the law requires. Customers and suppliers control the entries they make themselves, as described in their own terms.

5. Customers and suppliers on your projects

Customers and suppliers use Garmushka for free with accounts of their own. You decide what each of them sees. Commissions, internal notes and ratings are never shown to customers. A supplier’s quote goes only to you; suppliers never see each other’s prices.

6. Support access

To give support, investigate a problem or keep the service secure, authorised Garmushka staff may access your studio and accounts, including by signing in as a user. Every such access is recorded in our internal log.

7. Acceptable use

• Do not use the service against the law or to harm others.
• Do not send unwanted messages (spam) through it.
• Do not try to get around its security, access another studio’s information or overload the service.
• Do not copy or resell the service itself.

8. Limitation of liability

The service is provided “as is” and its calculations — quote totals, VAT, the cost of works, instalments and commissions — are aids. Decisions about choosing suppliers, amounts and commitments to customers and suppliers are yours. A preference a customer indicates is not consent and does not bind anyone. Payments recorded in Garmushka are records only; Garmushka does not hold or move money.

To the fullest extent the law allows, we are not liable for indirect or consequential damage, loss of profits or loss of data, and our total liability will not exceed the amount you paid us in the twelve months before the event.

9. Leaving

You may stop using the service and delete your account or your studio at any time, after downloading your data. A deleted studio can be restored for thirty days. Each customer on its projects is offered to keep their project read-only on a paid plan; otherwise it is deleted or anonymised with the studio. We may suspend an account that breaches these terms.

10. Governing law

These terms are governed by the laws of the State of Israel, and the courts of [to be completed] have exclusive jurisdiction.
